Promotional Game Rules

Important: Growth Lab Games facilitates promotional engagement tools for sellers and creators. All prizes awarded through our platform are promotional value only — they are not cash prizes, sweepstakes, or lotteries under applicable law. No purchase is necessary to participate. Void where prohibited.

1. Nature of Promotional Games

Growth Lab Games provides interactive engagement tools — including Prize Wheels, Lucky Draws, Live Polls, and similar features — for use by sellers, creators, and hosts ("Operators") during live commerce events, streams, and in-person gatherings.

All prizes distributed through these tools are promotional value only and may include:

  • Store credits or account credits
  • Discount coupons or promotional codes
  • Free shipping offers
  • Bonus content, early access, or digital perks
  • VIP experiences or special access
  • Physical merchandise or gift packages (at Operator discretion)

No cash prizes are offered or distributed through Growth Lab Games. All promotional prizes have no cash equivalent and are non-transferable.

2. No Purchase Necessary — Alternative Method of Entry (AMOE)

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A purchase will not increase your chances of winning. Void where prohibited by law.

Free Alternative Method of Entry: To enter any prize game without making a purchase, eligible participants may submit a free entry by:

  1. Mail-in Entry: Hand-print your name, email address, date of birth, and the name of the specific promotion on a 3" x 5" card and mail it to: Growth Lab Games Promotions, [Company Address]. One mail-in entry per outer envelope. Entries must be postmarked by the promotion end date and received within 7 days thereafter.
  2. Email Entry: Send an email to entry@growthlabgames.com with the subject line "Free Entry — [Promotion Name]" and include your name, date of birth, and the promotion you wish to enter. One email entry per person per promotion.

Free entries have the same odds of winning as paid entries. Limit one (1) free alternative entry per person per promotion period. Mechanically reproduced entries are not eligible.

3. Eligibility

Participation in promotional games is open to individuals who:

  • Are 13 years of age or older (or the age of majority in their jurisdiction)
  • Are not employees, contractors, or immediate family members of Growth Lab Games or the Operator
  • Reside in a jurisdiction where such promotions are not prohibited by law

Operators are solely responsible for ensuring their promotional games comply with all applicable local, state, federal, and international laws in the jurisdictions where they operate.

4. How Winners Are Selected

Prize Wheel: Winners are determined by a random weighted spin algorithm. Each segment's probability is proportional to its assigned weight. The outcome is determined at the moment of the spin and is final.

Lucky Draw / Raffle: Winners are selected by a random draw from all eligible entries. Each participant receives one entry unless bonus entries are explicitly offered by the Operator. The draw is conducted in real time and the result is final.

Live Poll: Poll results reflect actual votes cast by participants. No prizes are awarded through polls unless the Operator explicitly designates a prize for a specific outcome.

5. Prize Redemption

Winners receive a unique redemption code at the time of winning. This code must be used in accordance with the Operator's redemption instructions. Growth Lab Games is not responsible for the fulfillment of prizes — all prize fulfillment is the sole responsibility of the Operator.

Redemption codes are:

  • Single-use only
  • Non-transferable and have no cash value
  • Subject to expiration as determined by the Operator
  • Valid only for the specific prize described at the time of winning

6. Operator Responsibilities

Operators who use Growth Lab Games promotional tools agree to:

  • Comply with all applicable laws governing promotions, sweepstakes, and giveaways in their jurisdiction
  • Clearly disclose the nature and value of prizes to participants
  • Honor all prizes awarded through the platform
  • Not use the platform to conduct illegal lotteries, gambling, or cash prize distributions
  • Obtain any required permits or registrations for promotions in their jurisdiction (e.g., New York and Florida require registration for sweepstakes with prizes over $5,000)
  • Not target minors with promotional games without appropriate parental consent mechanisms

7. Prize Taxes & Reporting

Winners are solely responsible for all applicable federal, state, and local taxes on prizes received. The following tax rules apply:

  • Prizes valued at $600 or more: Winners must complete and return a W-9 form (U.S. residents) or W-8BEN form (non-U.S. residents) before the prize is awarded. Growth Lab Games or the Operator will issue a Form 1099-MISC for prizes valued at $600 or more in a calendar year as required by IRS regulations.
  • Prizes valued at $5,000 or more: Federal income tax withholding of 24% may apply. Winners will receive a Form W-2G.
  • All winners: By accepting a prize, you agree to provide accurate tax identification information upon request. Failure to provide required tax documentation will result in forfeiture of the prize.
  • Non-cash prizes: The fair market value of non-cash prizes (merchandise, experiences, credits) is taxable income to the winner.

Important: Growth Lab Games does not provide tax advice. Consult a qualified tax professional regarding your specific tax obligations as a prize winner.

8. Limitation of Liability

Growth Lab Games provides the promotional game platform "as is" and is not responsible for:

  • The fulfillment, quality, or delivery of any prizes
  • Any disputes between Operators and participants regarding prizes
  • Technical failures that may affect game outcomes
  • Any tax liability arising from prizes received

Winners are solely responsible for any applicable taxes on prizes received. Growth Lab Games does not issue tax forms for promotional prizes.

9. Privacy & Data

Growth Lab Games does not collect personal information from participants during gameplay. No name, email, or contact information is required to participate in a promotional game. See our Privacy Policy for full details on our data practices.

Operators who collect participant information (e.g., for prize fulfillment) are responsible for their own privacy compliance, including GDPR, CCPA, and other applicable regulations.

10. Geographic Restrictions

These promotional games are void where prohibited by law. It is the Operator's responsibility to restrict participation from jurisdictions where such promotions are not permitted. Growth Lab Games makes no representation that the platform is appropriate or available for use in all locations.

11. Intellectual Property

All content on the Growth Lab Games platform — including but not limited to software, design, graphics, logos, and text — is the original work of Growth Lab Games or is used with permission. Growth Lab Games does not use copyrighted material without authorization.

Operators are responsible for ensuring that any content they upload or display through the platform (including prize descriptions, images, and branding) does not infringe on third-party intellectual property rights.

12. Governing Law

These rules are governed by the laws of the United States. Any disputes arising from promotional games shall be resolved in accordance with the dispute resolution provisions in our Terms of Service.
