Terms of Service

1. Acceptance of Terms

By accessing or using Growth Lab Games ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. These Terms apply to all users, including hosts, sellers, buyers, players, and visitors.

2. Description of Service

Growth Lab Games is a live interactive commerce and entertainment platform that allows hosts and sellers to run real-time games, live shopping sessions, raffles, trivia, bingo, and other interactive experiences for audiences. The Platform also includes the Exchange marketplace, virtual gifting features, and community tools. The Platform is operated by the Shamelyss Growth Project.

3. Eligibility

You must be at least 13 years of age to use this Platform. Users under 18 must have verifiable parental or guardian consent. Users under 13 are strictly prohibited from using the Platform, creating accounts, or making any purchases. By using the Platform, you represent and warrant that you meet the applicable age requirement. We reserve the right to terminate any account where age misrepresentation is discovered.

To purchase items, send virtual gifts, or participate in paid features, you must be at least 18 years of age, or 13–17 with documented parental consent and a parent-controlled payment method.

4. Beta Access

Growth Lab Games is currently in private beta. Access is granted at the sole discretion of the Founder. Beta access may be revoked at any time. Features available during beta may change, be removed, or be modified before general availability. Beta users agree to provide feedback and understand that the service may be unstable.

5. User Accounts

Host and seller accounts require registration and approval. You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to terminate accounts that violate these Terms.

6. Virtual Gifts

The Platform offers virtual gifts (such as animated roses, fire, crowns, and other cosmetic items) that users may send to hosts or other users during live sessions. The following terms apply to all virtual gifts:

• No Cash Value: Virtual gifts have no monetary value and cannot be redeemed for cash, credit, or any real-world currency under any circumstances.
• Non-Refundable: All virtual gift purchases are final and non-refundable once sent.
• Cosmetic Only: Virtual gifts are purely cosmetic and display as animations during live sessions. They do not confer any rights, benefits, or advantages to the recipient beyond the visual display.
• Age Restriction: Users under 18 may not purchase virtual gifts without documented parental consent and a parent-controlled payment method.
• Platform Discretion: We reserve the right to modify, discontinue, or remove virtual gift types at any time without notice or compensation.

7. Gift Purchases ("Gift to Open Box")

Users may purchase physical products and designate another user as the recipient ("Gift to Open Box"). The following terms apply:

• Real Purchases: Gift purchases involve real money and result in a real physical product being ordered. Standard purchase terms, shipping costs, and seller policies apply.
• Recipient Rights: Recipients may accept or decline any gifted item within 72 hours. Declined gifts are refunded to the original purchaser minus any processing fees.
• No Obligation: Recipients are never obligated to accept a gift. Declined gifts carry no social penalty on the Platform.
• Age Restrictions: Age-restricted products may only be gifted to users who have completed age verification.
• Fulfillment: The seller is responsible for fulfilling gifted orders under the same terms as standard orders. Buyer protection policies apply.

8. Sweepstakes, Raffles, and Prize Games

The Platform includes prize-based games including Prize Wheel, Lucky Draw (Raffle), Live Bingo, and other sweepstakes-style features. The following terms apply to all prize games:

• No Purchase Necessary: No purchase is necessary to enter or win any sweepstakes or prize game on the Platform. A free alternative method of entry (AMOE) is always available. See our Sweepstakes Rules for details.
• Skill vs. Chance: Trivia games are skill-based contests. Wheel spins, raffles, and bingo are games of chance.
• Prize Taxes: Winners are solely responsible for any applicable federal, state, or local taxes on prizes. Prizes valued over $600 USD may require submission of a W-9 form for 1099 tax reporting.
• Geographic Restrictions: Prize games may not be available in all jurisdictions. Void where prohibited by law.
• Age Requirement: Prize game participants must be at least 18 years of age, or 13–17 with parental consent where permitted by applicable law.

9. Acceptable Use

You agree not to use the Platform to:

• Post or transmit content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Impersonate any person or entity
• Engage in any activity that disrupts or interferes with the Platform
• Attempt to gain unauthorized access to any part of the Platform
• Use the Platform for illegal gambling or any activity that violates applicable law
• Collect or harvest user data without consent
• Manipulate prize games, raffles, or sweepstakes through fraudulent means
• Send unsolicited gifts or harass other users through the gifting system
• Attempt to convert virtual gifts to cash value through any means

10. Content

Hosts and sellers are responsible for all content they create and share on the Platform, including questions, prizes, product listings, and game configurations. By submitting content, you grant Growth Lab Games a non-exclusive, royalty-free license to use, display, and distribute that content in connection with the Platform. We reserve the right to remove any content that violates these Terms.

11. Subscriptions and Payments

Paid plans are billed monthly or annually. All payments are processed securely through Stripe. Subscriptions automatically renew unless cancelled. Refunds are handled on a case-by-case basis. Prices may change with 30 days notice. During beta, pricing may be offered at a discount or free of charge.

Seller payouts are processed through Stripe Connect. Growth Lab Games charges a platform fee on each transaction as disclosed at the time of sale. Sellers are responsible for all applicable taxes on their earnings and must complete any required tax documentation (including W-9 or W-8BEN) upon request.

12. Intellectual Property

The Platform, including its design, code, trademarks, and content created by Growth Lab Games, is owned by the Shamelyss Growth Project and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

13. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

14. Limitation of Liability

To the maximum extent permitted by law, Growth Lab Games and the Shamelyss Growth Project shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to losses arising from virtual gift purchases, prize game outcomes, Exchange transactions, or gifted product fulfillment.

15. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except where prohibited by law.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or platform notification at least 14 days before the changes take effect. Continued use of the Platform after changes constitutes acceptance of the new Terms.
